This book collects four criminal indictments against Donald Trump and features extensive annotations, commentary and introduction from both of us.

And you and I actually as part of our day jobs following all of this, but I actually turned to that cast of characters a lot.

The Trump Enditments. This dark charging documents with commentary.

And so we thought it would be really important for those who are following the trials or just reading the indictments at home to hear some of those insights to understand what choices were made and why they were made and what they might mean going forward into a criminal trial.

And so you can correlate that so that you don't have to sit there and go wait a second who is number one again and who is number five and it makes it much more readable and you know that's the kind of thing even though I view an I sort of around discussing this all the time either on TV or podcast you can sort of forget because it's so confusing.

And so it doesn't matter if you think somebody might be guilty or not that sort of irrelevant in terms of how the legal process is best to work.

I mean, I have written speaking indictments in the Edron case that you referred to Melissa earlier. We had speaking indictments.

And I think one of the takeaways from this indictment and we talk a little bit about this in the book. Jack Smith also understands the value of prosecuting in the court of public opinion and that's what this is.

And Mike Pence, in his book, has already said that he was sort of horrified when he saw that.

Cohen is a quote unquote bad witness because Cohen was chosen by Mr. Trump to do all the things, the lying, the cheating, whatever that allowed the dirty work.

So I was fascinated by that. But my first impression was I went back to pages 143 and 144 of the book I wrote about the Muller investigation and people are probably going what? Why are we hearing about the Muller investigation?

So what I recount there and I got I still remember it in the summer of 2017 we started in basically in June of 2017 and shortly after we started I was communicating with a defense lawyer for a bank and we were looking at Information involving Michael Cohen where a bank had filed a report that involved a payment related to a Russian oligarch that had been received in an account related to Michael Cohen and The defense lawyer is sending us this report saying I want to give you a heads up because you're gonna get it eventually So I'm just gonna send it to you directly And so he does and I pull it up in my email and I'm reading it but the bottom half of the report relates to a $130,000 payment by Michael Cohen to an account that at the time we didn't understand what it was But we did some quick googling and we saw it was related to an adult film star However, you want to describe it and I first see it I bring in Jeannie Rhee because she's sort of dealing with a Russian part of the investigation and we google and we see that it's Related to something something called Stormy Daniels, which we didn't know what it was and I remember we both were like Oh like just a sinking feeling and we go into Robert Mueller and say this is my term I said we have a blue dress problem referring back to the Bill Clinton issue. We didn't want anything salacious We had a very defined remit But we realized that we couldn't ignore this information and it was something that could potentially relate to campaign federal violations by Michael Cohen It could relate to false statements to a bank about the purpose of creating this account and thus leverage To get him to cooperate. So that was sort of the genesis of all of this We ultimately split the Michael Cohen case in two and we kept sort of the directly Russian related piece and gave the quote blue dress unquote right pace of it to the US Attorney's Office You're straight, right? Yep. And so that was the Him. Yes, exactly

He said in his New York Times piece, he wrote it was the 13 page statement of facts that brought me two tears, right? This is the guy who was the number two at the National Enquirer, okay, because of the role they played in Catch and Kill and not just one story, multiple stories.

And then there's an introduction to each of the indictments and there's an overarching introduction I'm actually very proud of because we try to situate the indictments both in terms of the Department of Justice practices and other cases that have been brought as well as trying to situate them in terms of globally other countries.

And we have a whole litany of the book.

And you can tell I'm going through this because I feel guilty.

The idea is to really try and just like what we're trying to do here, it's really similar. We're trying to make this understandable.

This week on my podcast, Wise is Happening, author Eric Kleinenberg, author of 2020, One City, Seven People, and the Year Everything Changed.

Many of those historians have filed briefs in our support in this case, making the point that the idea of the 14th Amendment was that both states and the federal government would ensure rights and that if states failed to do so, the federal government certainly would also step in.

And you look at Foner or Foote, Shelby Foote or McPherson, they all talk about, of course, the conflict after the Civil War. And there were people who felt very strongly about retaliating against the South. The radical Republicans.

What the founders are much more worried about than using criminal prosecution to discipline presidents was what James Madison calls in Federalist Number 47, the newfangled and artificial treasons. They were much more concerned about the abuse of the criminal process for political purposes to disable the presidency from factions and political opponents. Of course, that's exactly what we see in this case.

Yeah, if you look actually at what is said in the Federalist Number 65 by Hamilton about that, high crimes and misdemeanors basically cover anything that the US Senate makes a political judgment justifies removing him from office and authorizing prosecution-

You see that in Hamilton's writings in Federalist 65, 69, and 77. You see it reflected at Madison's concern about newfangled and artificial treasons in Federalist 47, and that is the original meaning of the Constitution.
