I read his book very carefully. And if he testifies consistent with his book, then President Trump will be acquitted for these reasons.

It's also the case that the government will argue some amount of waiver has taken place because Mike Pence has written a book in which he talks about a lot of things, including things that I'm sure the grand jury will want to know and prosecutors will want to ask questions about that have already been divulged and peripheral to the things that have been divulged, also which have probably been waived.

It's one thing to say I shouldn't be compelled to talk about conversations. I shouldn't talk about certain events. But if you get a big fee for writing a book about it, that's problematic, isn't it?

In the book, Mike Pence only has to answer the questions that Mike Pence poses to himself. Obviously what he doesn't want to do is answer the questions prosecutors have for him.

But I agree with you. Pence is someone who's written a book, made money off of it, gone on, you know, the campaigning that people do to sell their book once it's published.

All of that he was happy to do. It's only when Jack Smith wants to get him under oath or Congress wants to get him under oath that he suddenly throws up his hands and claims principle.

Mike Pence is trying to cloak himself in separation of powers and executive privilege and talk about what a terrible precedent it would set for him to testify, even though, of course, he wrote a book and included all of this information and is making a buck off of it right now.

One way to completely get around the speech and debate clause immunity here, as you now know, is statements to the press are not legitimate legislative activity.

So Jack Smith can just basically say, hey, we're just going to ask him questions about what he said to the press. We want that to be under oath.
